Procedure for the Investigation of Allegations of Sexual Exploitation, Abuse, and Serious Misconduct

1. Purpose
Agundiz Design S.C. is committed to ensuring that all allegations of Sexual Exploitation and Abuse (SEA), Sexual Harassment (SH), fraud, corruption, or other serious misconduct are handled fairly, promptly, confidentially, and impartially.
This procedure establishes the organization’s process for receiving, assessing, and investigating allegations while respecting the rights, dignity, and safety of all individuals involved.
2. Scope
This procedure applies to:
- Employees
- Volunteers
- Consultants
- Contractors
- Board Members
- Interns
- Community Workers
- Partner Organizations
- Any person acting on behalf of Agundiz Design S.C.
3. Guiding Principles
Every investigation shall be conducted in accordance with the following principles:
- Fairness
- Impartiality
- Confidentiality
- Respect for due process
- Protection of survivors and witnesses
- Protection against retaliation
- Compliance with applicable Mexican law and United Nations partner requirements
4. Receiving an Allegation
Upon receiving a report, Agundiz Design S.C. will:
- Record the allegation.
- Protect confidential information.
- Assess immediate safety risks.
- Determine whether the allegation falls within the scope of this procedure.
- Take immediate protective measures when necessary.
5. Preliminary Assessment
The Founder & Director or an authorized representative shall conduct an initial review to determine whether:
- Additional information is needed.
- A formal investigation should begin.
- The matter should be referred to competent authorities.
- Immediate protective actions are required.
6. Investigation Process
When a formal investigation is initiated, Agundiz Design S.C. shall:
- Collect relevant information and documents.
- Interview individuals when appropriate.
- Maintain confidentiality throughout the process.
- Document findings objectively.
- Avoid conflicts of interest during the investigation.
7. Investigation Outcome
Following the investigation, Agundiz Design S.C. shall:
- Prepare a written summary of findings.
- Determine whether organizational policies have been violated.
- Recommend appropriate corrective or disciplinary actions.
- Refer matters to the appropriate authorities where required by law.
8. Record Retention
Investigation records shall be securely maintained with access limited to authorized personnel.
9. Review
This procedure shall be reviewed periodically and updated as organizational needs, legal requirements, and United Nations partner standards evolve.
10. Approval
